CONDITIONS OF ENTRY
1. The “Clark Street's Cannopoly 2023 Promotion” (“Promotion”) is conducted by CLARK STREET INVESTMENTS (BUSINESS NUMBER 802221534) of 6640 8 Mile Rd, Detroit, MI 48234 (“Promoter”).
2. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry and can be located on www.CannopolyGame.com (the “Promotional Website”). Entry into the Promotion is deemed acceptance of these Conditions of Entry by each Entrant.
3. Unless otherwise indicated, all times and dates specified in these Conditions of Entry are times and dates in Detroit, Michigan USA which may be in the time zones EST or EDT depending on the date.
4. In these Conditions of Entry, Your Local Dispensary that is participating in the Promotion are referred to as "Clark Street Investments", “Your Local Dispensary”, or "Clark Street".
5. Promotion starts at 00:01 (Detroit Time) on November 23rd 2022 and ends at 23:59 (Detroit Time) on July 23rd 2023 (the “Promotional Period”).
6. Eligible Products may be purchased between 00:01 (local time) on November 23rd 2022 and 23:59 (local time) on July 23rd 2023 (inclusive)(the “Purchase Period”).
ELIGIBILITY
7. Entry into the Promotion is only open to United States citizens and permanent residents (“USA Residents”) aged 21 years and older as at the time of entry who remain USA Residents for the duration of the Promotional Period (“Entrants”). The directors, management and employees (and their immediate family) of the Promoter, its related entities, related bodies corporateor franchisees, printers, suppliers, providers, software providers and developers, and agencies associated with this Promotion are ineligible to enter the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
8) Entrants must be or become registered members of CannopolyGame.com agree to participate in the Cannopoly Game in the manner directed within the Cannopoly Website App (“Application”) during the Promotional Period and remain registered members for the remaining duration of the Promotional Period in the manner required as set out in these Conditions of Entry in order to:
- a. enter into the Grand Prize draw by collecting cards and entering codes into the Application;
- b. claim a Collect to Win Prize;
- c. claim an Instant Win Prize;
9) All entries of Entrants who are aged less than 21 years who enter the Promotion while attempting to conceal (or without disclosing) their age (as and where required) and/or do not provide the required parental or legal guardian consent (as and where required) will be deemed invalid. All entries and attempted prize redemptions of persons who are aged less than 21 years old will be deemed invalid.
ELIGIBLE PRODUCTS
10) In this Promotion, each of the products listed below (“Eligible Products”), when purchased from a Your Local Dispensary during the Purchase Period is an “Eligible Product”. The Eligible Product entitles the purchaser, subject to these Conditions of Entry, to receive 1 (one) promotional scratch-off game card (a “Game Card”). 11) Any Eligible Products sold as part of a Cannopoly Game Promotion are included as Eligible Products for the purpose of the Promotion. Choice of Eligible Products is subject to availability at each Your Local Dispensary and is based on reasonably anticipated demand. Each Eligible Product may not be available for sale in all Your Local Dispensary at all times during the Purchase Period. The Promoter accepts no responsibility for any Eligible Product(s) being unavailable at a Your Local Dispensary during the Purchase Period.
12) Eligible Products may only be purchased when the relevant Eligible Product is available.
HOW TO ENTER
No purchase necessary. To receive a free digital game card, simply email "questions@CannopolyGame.com" with your full name, Cannopoly account username, and email. One game card will be assigned to your account at random. If you end up with a winning combination or an instant win card by this process then you will typically receive email notification within 24 to 48 hours. Check spam folders.
Qualifying purchases at Your Local Dispensary will include a game card which you scratch to reveal a code. Once you register, login, then enter the code into the App then that game card will be assigned to your account. If you collect a winning combination or game cards or any instant win game cards, then you will typically receive notice of a win within 24 to 48 hours via your email registered via the Cannopoly Registration page.
If you collect all required cards, or receive an instant win, then enter each of their code(s) into the system via the Enter Code page after registering and logging in, you will win the associated prize below:

Keeping Game Pieces and their codes safe: - For some prizes, it is mandatory to send winning Game Pieces to the Promoter or the prize-provider as part of that prize claim and, for all other prizes, the Promoter reserves the right to require the claimant to send the winning Game Piece or Game Pieces to the Promoter or the prize-provider for verification as a pre-condition to the prize claim being verified; verification can take place even after notification that an award is being, or has been, made.
Important: Please make sure Game Pieces are kept safe and undamaged and the Game Piece Code and any other code on a Game Piece are kept private without being revealed to anyone else (other than the Promoter as part of an online-entry or prize claim in accordance with these Rules). Failure to do this may result in the Promoter determining (in its discretion) that the Game Piece and its codes together with all associated prize claims are void (and the Promoter may take this action irrespective of whether or not there is any evidence to suggest that the failure has resulted or will result in a wrongful prize claim or other action).
LIMITATIONS
By participating in the Cannopoly game (the "Game"), presented by Clark Street (the "Company"), participants agree to the following: The Game is subject to all applicable federal, state, and local laws and regulations. The Game is void where prohibited or restricted by law. Employees of the Company and their immediate family members are not eligible to participate in the Game. The Company is not responsible for any errors or issues that may arise in connection with the Game, including but not limited to errors in advertising, the Official Rules, the selection and announcement of winners, or the distribution of prizes. The Company makes no representations or warranties of any kind concerning the prizes available in the Game. All taxes on prizes, and any other costs or expenses associated with the acceptance and use of a prize, are the sole responsibility of the winners. The Company is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Company on account of technical problems, human error, or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to participants' or any other persons' computers related to or resulting from participation in the Game or downloading any materials in the Game. The Company reserves the right to modify, suspend, or terminate the Game at any time, for any reason, without notice. By participating in the Game, participants agree to release the Company and its affiliates, partners, and advertising and promotion agencies from any and all liability, loss, or damage arising from or in connection with the awarding, receipt, and/or use or misuse of any prize. The Game is subject to the Official Rules, which are available at CannopolyGame.com. By participating in the Game, participants agree to be bound by the Official Rules and the decisions of the Company, which are final and binding in all matters related to the Game. By participating in the Game, participants acknowledge that they have read, understood, and agree to be bound by these disclaimers and the Official Rules.
LIMIT ONE (1) ACCOUNT PER PERSON. ADDITIONAL ACCOUNTS AND ENTRIES MAY BE DISQUALIFIED. Automated or bulk entries or entries submitted by third parties may be disqualified. Entries must be submitted by the participant. No copies, facsimiles, or mechanical reproductions of the entry form will be accepted. Any attempt by any participant to obtain more than the stated number of entries by using multiple and/or different identities, forms, email addresses, logins, or any other methods will disqualify that participant’s entries, and that participant and/or entries may be disqualified. Multiple participants are not permitted to share the same email address. In the event of a dispute as to any registration, the authorized account holder of the email address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder to the Clark Street or forfeit the prize. Entries specifying an invalid, non-working, or inactive email address will be disqualified. Incomplete, illegible, corrupted, or untimely entries will be disqualified.
SELECTION OF WINNERS: As game pieces are collected and prizes are claimed, Clark Street will notify the account holders via email of their winnings. The odds of winning are based on the number of eligible entries received. The potential winners will be notified by email on or before December 31, 2023. If a potential winner cannot be contacted in person via direct messaging the first attempt to contact him/her, Clark Street will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. If Clark Street is unable to determine and verify a potential winner after repeated alternate drawings or if Clark Street fails to receive a sufficient number of entries to correspond to the number of prize(s) available to be awarded, Clark Street reserves the right to not award the all prize(s). Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY Clark Street STAFF, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL PARTICIPANT’S ELIGIBILITY HAS BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. PRIZE RESTRICTIONS: Limit one prize per person and per household. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of winner. Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Clark Street reserves the right to make equivalent prize substitutions. Clark Street will not replace any lost or stolen prizes or components of a prize. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available.
GENERAL CONDITIONS: Participation constitutes participant’s full and unconditional agreement to these Official Rules and to Clark Street’s and/or Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Clark Street, and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, telephone transmission problems, or garbled transmissions or miscommunications; computer or software malfunctions, or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Clark Street. Clark Street’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
WARNING: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, Clark Street RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
DISQUALIFICATION: Clark Street reserves the right to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any website associated with the Sweepstakes, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. Clark Street reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any factor beyond Clark Street’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Clark Street. If, for any reason, the Sweepstakes cannot be run as planned, Clark Street may disqualify any suspect entries and (a) suspend the Sweepstakes and modify the Sweepstakes to address the impairment, then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (b) terminate the sweepstakes and award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.
NON-AFFILIATION WITH MONOPOLY: The Cannopoly game is not affiliated with the Monopoly board game and is not sponsored, endorsed, or administered by Hasbro, Inc. Clark Street is not responsible for any errors or omissions in the rules or terms of service of the game. All prizes are subject to availability and the terms and conditions of the prize provider. Clark Street is not responsible for the availability or fulfillment of any prizes. By participating in the Cannopoly game, customers agree to be bound by these rules and the decisions of Clark Street, which are final and binding in all matters related to the game. Clark Street reserves the right to disqualify any participant who violates the rules or engages in any conduct that is detrimental to the game or to Clark Street. All prizes, including "Free Cannabis for Life*" is subject to local, state, and federal laws. Clark Street is not responsible for any legal or regulatory issues that may arise from the winner's use of the prize.
LIMITATION OF LIABILITY AND RELEASES; PUBLICITY;
BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANT AGREES THAT SWEEPSTAKES ENTITIES, AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY PARTICIPANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES-RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. PARTICIPANT HEREBY GRANTS TO THE Clark Street AND ITS LEGAL REPRESENTATIVES, SUCCESSORS AND ASSIGNS, AN IRREVOCABLE, AND WORLD-WIDE LICENSE TO USE IN PERPETUITY THE MATERIALS IN ANY FORM OR FORMAT AND TO MODIFY THE SAME AND ACKNOWLEDGES AND AGREES THAT IF Clark Street DOES USE THE MATERIALS PARTICIPANT SHALL NOT BE ENTITLED TO ANY CREDIT, CONSIDERATION, NOTICE OR PAYMENTS OF ANY KIND. PARTICIPANT WAIVES ANY MORAL RIGHTS HE OR SHE MAY HAVE TO THE MATERIALS AND AGREES THAT IF Clark Street ELECTS TO USE MATERIALS FOR ANY PURPOSE, ALL RIGHTS UNDER COPYRIGHT OR OTHER INTELLECTUAL PROPERTY RIGHTS WHICH MAY RESULT FROM THAT RELATING TO PARTICIPANT’S MATERIALS OR FROM USE OF THE SAME BY Clark Street SHALL BE THE SOLE PROPERTY OF Clark Street. PARTICIPANT FURTHER AGREES THAT IF Clark Street ELECTS TO USE PARTICIPANT’S MATERIALS, PARTICIPANT WILL EXECUTE ANY DOCUMENTS REQUESTED BY Clark Street REGARDING THIS ASSIGNMENT. IF ANY USE BY Clark Street OF THE MATERIALS CAUSES IT TO BE LIABLE TO ANY THIRD-PARTY, PARTICIPANT AGREES TO INDEMNIFY SWEEPSTAKES ENTITIES FROM AND AGAINST ANY AND ALL DAMAGES, COSTS, JUDGMENTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY FEES) WHICH IT INCURS AS A RESULT OF ITS USE OF THE MATERIALS. MATERIALS WILL NOT BE RETURNED TO PARTICIPANTS. WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE WEBSITE AND ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. This Sweepstakes is governed by the laws of the United States. Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Michigan or the appropriate State Court located in Muskegon or Wayne County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes not to exceed fifty US Dollars (US$50.00), but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Clark Street in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
Clark Street is not responsible for any injuries, losses, or damages of any kind resulting from participation in the game or acceptance, possession, or use of any prize. All prizes are provided "as is" without any warranty or representation of any kind. The game is open to legal residents of the United States who are 21 years of age or older at the time of entry. Employees of Clark Street and their immediate family members are not eligible to participate in the game. Clark Street is not responsible for lost or stolen game pieces or codes. Clark Street reserves the right to disqualify any player for any reason, including but not limited to, fraud or tampering with the game. By participating in the game, players agree to be bound by these rules, terms and conditions, and the decisions of Clark Street, which are final and binding in all matters related to the game.
